Verification and Stamping of Weights or Measures

  1. Any business entity having any weight or measure in his possession used by them in any transaction or for protection must, before putting such weight or measure into use, have them verified as the Controller may, by general or special order, specify on payment of fees as prescribed.
  2. The Central Government can prescribe the weights and measures for which the verification will be done through the Government-approved Test Centre.
  3. The Government-approved Test Centre must be notified by the Government, in such a manner, on terms and conditions and payment of fees as prescribed.
  4. The Government-approved Test Centre must appoint people with qualifications and experience. Also, they must collect the fee on terms and conditions to verify weights and measures specified under the LMPC Act.

Inspection and Seizure of Weights and Measures

  • The Director can, from any information given to him by any person that any weight or measure that has taken place and in respect of which an offense punishable under this Act appears to have been committed are either kept in the premises or are in the course of transportation:
    1. Enter at any reasonable time into any premises and search for and inspect any weight, measure, or other goods in relation to trade and commerce.
    2. Seize any weight, measure, or other goods and any record, register, or other document or article that may furnish evidence indicating that an offence has been committed during any trade and commerce.
  • The Director can also demand the production of every document relating to the weight or measure. So, the person with custody of such weight or measure must comply with such requisition.
  • When any goods seized are subject to speedy or natural decay, the Director can dispose of such goods in a manner as prescribed by the Authority.
  • Every search or seizure made must be carried out in accordance with the provisions of the Code of Criminal Procedure, 1973, relating to searches and seizures.

 The licensee must adhere to the rules and regulations set forth by the Legal Metrology Department.

According to the Rule 11 of Legal Metrology Enforcement Rules 2011, the renewal application must be submitted 30 days before the last date of original license. The
