  • The company should be clean, i.e. there should be no current legal cases lodged against the company at the Department of Enforcement or the Department of Revenue Intelligence.

  • Although forex trading is part of Full Fledged Money Changer, don't mistake this license with the Forex trading license or the Forex broker license. To get a Forex trading license in India, you'll need to adhere to the Forex Trading License requirements beyond the scope of a simple FFMC.
  • You'll encounter sources that claim to have a money changer license for sale over your research. Don't fall into that trap. Report it the moment any such entity or individual.

FFMC License Renewal Process

The FFMC registration license’s renewal procedure takes place in the following manner:

  • The renewal application from an FFMC license holder must be made two months before the expiry of the licence or the period as the Reserve Bank of India may prescribe. Along with the application, the following documents must be attached:

    • Copy of the latest audited accounts with a certificate from the Statutory Auditors regarding the position of Net Owned Funds.

    • Confidential Report from the applicant's banker in a sealed cover.

    • A declaration to the effect that no proceedings have been initiated by/ are pending with the Directorate of Enforcement / Directorate of Revenue Intelligence or any other law enforcing authorities against the applicant company or its directors and that no criminal cases are initiated/ pending against the applicant company or its directors.

    • A copy of the KYC / AML / CFT policy framework existing in the company.

  • Suppose the RBI accepts the FFMC licence renewal application. In that case, the licence can continue in force until the new licence expiry date.

  • The RBI will not entertain any FFMC registration renewal application after the expiry of the licence. So, make sure to apply for the license well in advance. 

FFMC Guidelines Under Which RBI Can Revoke the License of AMC

The Reserve Bank has the right to revoke the license which is granted to an AMC at any time in the following circumstances:-

 

  • In case there is an issue related to public interest.

  • In case of infringement of any statutory or regulatory provision.

  • The RBI may revoke existing conditions or impose new conditions on the license of the AMC.

  • AMC has failed to comply with the set standards of the Foreign Exchange Management Act, 1999 or any rule, regulation, or notification, made by the authority.
