Legal Metrology Registration in India

Legal Metrology refers to the branch of science that deals with measurement and the regulation of measuring instruments commonly used in trade and commerce. In India, the Legal Metrology Act 2009 governs these regulations and ensures fair trade practices as well as consumer protection.

It is mandatory for manufacturers, importers, repairers, packers and dealers of weighing and measuring instruments to secure a Legal-Metrology Certificate.

About Legal Metrology Registration

Legal Metrology Registration is the process businesses must follow to officially register if they are involved in making, selling, importing, dealing in or repairing weights and measuring instruments. It's required under the LMA 2009 to make sure everyone follows standard rules, promotes fair trade and protects consumers from inaccurate measurements.

In India, each and every state/union territory has a Legal Metrology Department (LMD) of its own, for the purpose of providing registration to manufacturers, repairers, dealers, packers and importers of pre-packaged commodities.

The exact type of registration required depends on the nature of the business activity, and entities must comply with the applicable rules and obtain the appropriate certificate before they can commence their operations. In case of non-compliance, the offender is liable for penalties, seizure of goods or legal action under the provisions of the LMA Act 2009.

Licenses Under Legal Metrology Act 2009

There are various legal-metrology licenses and registrations under LMA 2009, including:

How to Get a Legal Metrology Certificate / License?

The steps required to get a legal metrology certificate or license are described below :-

Step 1:- Collection of Required Documents

To obtain a legal metrology certificate, you need to collect all the necessary documents. The exact documents required depend on the type of legal metrology certificate/license. For instance, in case of an importer license of legal metrology, import export code (IEC), issued by DGFT, is one of the most crucial documents. However, it isn’t required for a packer license.

Step 2:- Filing an Application with Competent Authority

Once all the necessary documents are in place, you must file an application with the appropriate competent authority in the prescribed format. For issuing legal metrology licenses for manufacturing and repairing, the competent authority is the Controller of Legal Metrology, operating at the state level under the Department of Consumer Affairs. Therefore, for a state-level legal metrology certificate, you must file an application with the Controller. However, for the national-level licenses like importer license and packer license, the Director of Legal Metrology, Government of India is the competent authority.

Step 3:- Submission of Application

Once you have accurately filled out the application form, you must move ahead and submit it along with the necessary documents. Along with the form and documents, you must pay the prescribed application fee to the competent authority. The fee depends on the type of legal metrology certificate you want to secure.

Step 4:- Review of Application

Once the competent authority receives the application form, it’ll carefully review all its details. If the application aligns with all the requirements set forth by the government, the authority will issue the legal metrology certificate in the name of the applicant. Generally, the certificate is issued within 5-7 working days from the date of submission, provided that the application is complete, accurate, and free from any errors or missing information.
