How to Register the Trademark in Mumbai

Once you have accumulated the above mentioned documents along with your mark onto an optimal medium, you can begin the process of trademark registration.  The entire process involves the following two steps:

  1. Make sure to identify the mark from your side:  This step belongs to prior to the registration. In this process, you will need to make sure that your proposed mark adhered to all the necessary standards of Trademark 1999. Now, this might be a little hard to do. So simply do some research to see whether your mark is copied or not. Now, after you are confirmed from your end, fill the application and forward it to the trademark agent.
  2. Checking for availability: Once you have forwarded your mark to a trademark agent, they will check all the necessary details about it to see if the mark follows all the necessary regulations. This can be done both online and offline. If there are any issues, you will have to redesign the mark and repeat this step over and over again, until the agent is fully satisfied.
  3. The mark then goes for codification:

Once the trademark agent has checked and submitted the application, it will go for Vienna codification. During this process, it is checked under which class does the mark falls into. Once the class of the mark is established, the final process begins. In the meantime, you can put the “TM” symbol beside your design.

  1. The scrutiny of trademark office:

This final step is the longest one. It involves the final submission of application to the trademark office. There, the officer will check each and every detail of the mark and the applications; details that might have been missed in the previous steps. If there are no issues, the mark is posted in the trademark journal. This step will tell the people as to where the mark will be put in the trademark journal for a period of 3 to 4 months. This posting will provide the masses to look at the mark. If there are no objections, your trademark will be registered and you can then use the “R”. However, if there are any objections, you would have to address them and depending upon the decision, you will either be allowed to have the trademark or will have to reinitiate the entire process.
