What is Trademark Journal ?

The Trademark Journal is a journal published by the Trademarks Department, Ministry of Commerce & Industry of GOI. Within 4 months from the date of Trademark Journal’s publication, if any person has any trademark objection regarding any trademark, he can file notice of opposition against it. The purpose of publishing this journal is to create public awareness about any trademark applications received by the registrar. 

Trademark Journal: Definition

A trademark journal is a publication which consists of all the details relevant to the trademarks accepted by the Trademarks Department. The trademarks are advertised by the registrar of trademarks. Anyone can access this weekly journal by visiting the official website of the registrar of trademarks. A window of 4 months is provided to the public to raise any objections related to the trademark from the advertising date of the journal. In case there is no objection raised, a registration certificate is provided to the trademark owner.

Why is Trademark Journal Necessary?

Trademark journal plays an important role in the entire trademark registration process. This journal is necessary due to the following reasons:

• In this journal, all the important deadlines are mentioned from the date of publication of the advertisement.
• This journal also states the deadline for raising an objection against any trademark which has been advertised in the trademark journal.
• It is only after the expiry of the deadline of 4 months since the publication of a trademark in this journal that an applicant receives the trademark certificate. This journal also provides the deadline of the trademark certificate’s issuance.

Components of a Trademark Journal

Every Monday, the trademark journal is published on IP India’s website by the Trademark Registry. The following components make up the Trademark Journal:

• Notices and public notifications in the journal are issued by the Registrar’s Office.
• All the trademark applications which are approved or instructed to be advertised before approval are mentioned in the trademark journal.
• The trademark applications which are ordered to be re-advertised by a competent.
• List containing all the trademarks which have been added, registered, removed, withdrawn or renewed.
• Any changes in trademarks after registration such as transfer, assignment and other similar changes are also a part of this journal.
• The journal includes the amendments and updates regarding the trademark applications.
• The names of international non-proprietary trademark holders published by WHO are also mentioned in the Trademark Journal.
• Any information that is considered necessary is also published in this journal.

Contents of a Trademark Advertisement in Trademark Journal

The following details are included in the trademark advertisement published in the trademark journal:

• Priority claim, if any
• Application’s date
• Application and the applicant’s details
• Proposed Trademark for registration
• Applicant’s address
• Class of goods/services which are proposed to be trademarked
• A statement of the use of the trademark
• Appropriate office of the trademark.
• Public notifications and notices issued by the trademark office.

Steps to Access the Trademark Journal

The trademark journal gets published on a weekly basis i.e., every week on Monday in a pdf format, by the Trademark Registry on its official website. Every journal is available for a period of 20 days from the date of publication so that the general public can access it.

• In order to access the trademark journal, you have to follow the steps mentioned below:
• First, you must visit the official website of Intellectual Property India (Ministry of Commerce and Industry).
• From the top menu, click on ‘Trademarks’, then go to Publications, and then ‘TMR Journals’.
• Once you click on ‘TMR Journals’, you will be directed to a page which contains a list of class-wise journals.
• You can select the appropriate journal manually or use the search option available on the page.
• In order to get correct search results, you can fill in details such as the application number, keywords, address of the applicant, abstract, or class of the journal.
