The Act allows BOCW registration for workers between 18 to 60 years of age as long as they have worked for more than 90 days in the last 12 months.

Objectives of BOCW

The BOCW Act, 1996, has the following key objectives and features. :-

• One of the primary objectives of the Act is to make sure the construction/building workers across different parts of India receive adequate welfare measures, safety protections and improved working conditions.

• Another key objective of the Act is to provide legal rights to the construction/building workers and prevent their exploitation in the unorganized sector.

• The Building and Other Construction Workers Regulation of Employment and Conditions of Service Act, 1996, mandates the establishment of BOCW welfare boards in each state and union territory in the country. These boards are responsible for managing funds from a cess on construction projects and implementing various social security schemes for registered workers.

• For the construction/building workers in India, the Act mandates safety measures. It requires employers to provide PPE like helmets, harnesses, gloves and safety shoes. Further, the employers must also conduct mandatory safety training.

• The BOCW Cess Act, a complementary law to fund welfare measures under BOCW Act, mandates the levy of a construction cess to fund various welfare measures for registered construction workers. The Central Government is empowered to set the construction cess.
