EPFO introduces 6-month Amnesty Scheme

The Employees’ Provident Fund Organisation (EPFO) has introduced the Amnesty Scheme 2026. This scheme is a one-time opportunity for establishments operating an ‘Exempted Provident Fund’ to regularize their status. According to the Ministry of Labour and Employment, the scheme will be open for a 6-month period. This scheme is applicable to establishments that have been managing a Provident Fund Trust recognized under the Income Tax Act of 1961. 

Eligible establishments must submit a formal application via email to the relevant Regional Office, as outlined by the Ministry. An ‘Exempted Provident Fund’ is an employer-managed PF scheme that handles its own provident fund contributions through a private trust rather than directly depositing them into the EPFO. 

Reports from Akashvani suggest that EPFO Amnesty Scheme provides a rare opportunity for eligible establishments that are operating recognized PF trusts to regularize their status retrospectively. The aim of scheme is to bring these trusts under a uniform statutory framework. At the same time, it intends to ensure compliance with relevant legal provisions. For employees, it is anticipated that the scheme will offer much greater clarity regarding the legal status of their employer’s provident fund trust.

Additionally, the scheme requires that member accounts must have received contributions and interest at rates that are equal to or better than the statutory EPFO rates for the prescribed reliefs to apply. The scheme is also anticipated to streamline the administration of provident fund benefits and enhance legal compliance by regularizing exempted PF trusts.
