FSSAI issues Notices to leading Energy Drink Brands

The Food Safety and Standards Authority of India has sent notices to six leading beverage brands, including Red Bull and PepsiCo India, due to issues pertaining to misbranding/misleading claims associated with their energy drink products. 

In a post on Instagram, the food regulator stated that it had issued notices to several brands for making misleading claims about their energy drinks. 

Which Energy Drink Brands Received a Notice from FSSAI?

The six energy drink brands identified by the regulator are as follows:

  • Red Bull Energy Drink, 

  • PepsiCo India Adrenaline Rush Energy Drink, 

  • Campa Energy Drink-Gold Boost from Reliance Consumer Products, 

  • Sting Energy Drink, 

  • Hell Energy 

  • Monster Energy, which is backed by Coca Cola. 

Comments from these brands were not available immediately. 

No FSSAI Standards for Energy Drinks Exist

FSSAI stated that it has not established any standards for "energy drinks" or similar products. It noted that these brands have marketed their products using descriptors like "energy drink" on their branding as well as labeling. 

Additionally, the food regulator made it clear that Food Category System outlined under FSS Regulations is not intended for product naming or labeling purposes.

Functional/Therapeutic Claims Not Allowed under FSS Act

The regulator stated that making functional or therapeutic claims is not permitted under the Food Safety and Standards Act of 2006 or any rules/regulations established under it. Claims like "vitalizes body and mind," "enhances focus," "boosts energy levels" or "helps with general weakness" among others are not permissible for food products. 

The notices issued to beverage companies come as part of a broader crackdown by FSSAI on misbranding, misleading claims and advertisements by food business operators. This action has also been taken based on consumer complaints.
