EPR Rules in India

In India, the rules that govern the EPR are as follows :-

  • The E-Waste (Management) Rules, 2022 :- These rules were notified by the Ministry of Environment, Forest and Climate Change. According to them, EPR registration is mandatory for manufacturers, producers, refurbishers, dismantlers, and recyclers of electrical and electronic equipment to ensure responsible collection, channelization and environmentally sound management of e-waste.

  • The Plastic Waste Management Rules, 2016 :- These rules notified by the MOEFCC offer a framework for plastic waste management. They make EPR registration mandatory for PIBOs involved in manufacturing, importing or selling plastic packaging/products in India.

  • The Battery Waste Management Rules, 2022 :- The MOEFCC implemented these rules, offering a framework for the management of battery waste. According to these rules, EPR certificate is mandatory for PIBOs of batteries placed on the Indian market. These PIBOs must ensure the collection, recycling and environmentally sound management of batteries that are no longer required by consumers and are now considered as waste.

  • The Hazardous and Other Wastes (Management and Transboundary Movement) Amendment Rules, 2022 :- In India, oil and tyre waste is managed primarily through the Hazardous and Other Wastes (Management) Rules, 2016 notified by the MOEFCC. These rules make EPR certification mandatory for PIBOs engaged in production, import, sale or distribution of tyres and waste oil generating products. The rules ensure proper collection, storage, recycling and environmentally responsible disposal.
