Now, the question is whether YouTubers and freelancers need to file EDF. Yes, according to the RBI’s new rule, they may need to comply with the EDF filing requirement when receiving payments from overseas for commercial export services provided to persons or entities outside India as part of their business.
The Reserve Bank of India’s new Foreign Exchange Management (Export and Import of Goods and Services) Regulations, 2026 recently came into effect on 1 October 2026. These regulations bring together the earlier 2015 regulations, Master Directions and 167 circulars into one framework. It does away with the need to refer to multiple regulations, Master Directions and circulars while undertaking export and import transactions and makes compliance much simpler.
Under the new FEMA export regulations 2026, exporters of services have to submit an Export Declaration Form. This form is required to declare the full value of the services exported. For services other than software, the Authorized Dealer in the domestic tariff area is responsible for this process. The EDF due date is within 30 days from the end of the month in which the invoice was raised.
The regulations generally require the full value of exported services to be released and repatriated to India within nine months from the date of the invoice. If an exporter is unable to submit the EDF on time, they can approach their AD bank for an extension and explain the reason for the delay. The bank may grant an extension if it considers the reason valid.
The EDF filing requirement is applicable to individuals in India who provide commercial export services, through business entities, to clients or entities outside India. It may include agencies, influencers, content creators, freelancers, consultants and several other service providers who earn money from overseas clients or entities in exchange for commercial export services.
To file EDF declaration form RBI, the eligible exporters generally need to follow the steps explained below:-
Step 1:- Contact your AD Bank and ask them whether your earnings require EDF filing.
Step 2:- If your earnings are eligible, then you must fill out the EDF form. In the form, you must provide all the required details, such as exporter name, PAN, AD code, invoice numbers, dates, etc.
Step 3:- Once you’ve entered all the details, make sure to cross-check them.
Step 4:- Then, submit EDF with your AD Bank within the 30-day window.
Step 5:- Once the AD receives your EDF form, it will upload and log the EDF details into the Export Data Processing and Monitoring System (EDPMS) of the RBI.
Step 6:- Once your foreign payment arrives, your AD Bank will record and match the inward remittance against the EDPMS entry. Upon realisation of the full value, the bank will mark the entry off.
After fulfilling all the aforementioned steps, the EDF filing process will be considered complete.
Failure to furnish the EDF form where required would constitute a direct contravention of the service-export declaration requirement u/s 7(3) of the Foreign Exchange Management Act, 1999 read with Regulation 3 of Foreign Exchange Management (Export and Import of Goods and Services) Regulations, 2026. Such a violation may attract penalties u/s 13(1), which can range up to three times the quantifiable amount involved or a fixed penalty of Rs. 2 lakh if the amount cannot be quantified.
Additionally, there may be a further penalty of up to Rs. 5,000 for each day that the violation continues. It’s important to note that these amounts represent maximum statutory penalties and do not get imposed automatically. Compounding u/s 15 may also be possible, subject to the relevant provisions.
