The Department of Telecommunications issues several regulations in relation to the compliance filing by various DoT license holders. But these compliance are subject to changes per the contemporary requirements of the Telecom Industry. Therefore, this article will discuss some of the forthcoming amendments and the DoT compliance checklist as required by the Authority.

DOT Compliance Services: Broadcasting & Cable Services Order

The latest Order issued by the Department of Telecommunications is the Telecommunication Broadcasting and Cable Services Order. It is established as the eighth Addressable Systems Tariff as per the Third Amendment Order of the year 2022.

The said Order is applicable throughout the territory of Indian territory. It will come into force from 1st February 2023. But the exception exists for clauses 4 and 5 of the said Order. It is said that the Order will come into force from the date of its publication. It will be released in the Official Gazette.

 

Clauses of the DoT Compliance Services Amendment

Principal Tariff Order: Clause 3

Clause 3 of the Telecommunication Broadcasting and Cable Services Addressable Systems Tariff Order of 2017 is referred to as the principal Tariff Order. The Order is detailed in the sub-clause of the official release and describes the following:

(a) There is a phrasal substitution in the second proviso from the words "rupees twelve" to the words "rupees nineteen."

(b) Another substitution is in the third proviso, replacing the existing structure with the following clause:

"Provided that the maximum retail price per month of such bouquet of pay channels must not be less than 55% of the sum of maximum retail prices per month of a-la-carte pay channels."

 

Principal Tariff Order: Clause 4

Clause 4 of the principal Tariff Order is amended in the following terms:

(a) There is a phrasal substitution in the second proviso from the words "rupees twelve" to the words "rupees nineteen."

(b) There is another substitution in the first proviso from the words "rupees twelve" to the words "rupees nineteen."

 

Principal Tariff Order: Clause 6

Clause 6 of the principal Tariff Order is amended in the following terms:

The Amendment has inserted the following first proviso in the sub-clause (1):

"Provided further that any change in the following due to the Third Amendment Order of  2022 Telecommunication Broadcasting and Cable Services 8th Addressable Systems Tariff must be reported to the Authority on its official portal as specified at least 45 days before such a change:

  • Name
  • Nature
  • Language
  • Maximum Retail Prices per month
  • Maximum Retail Prices of channels
  • Total Retail Price per month
  • Composition of Bouquets"

The specified changes must be simultaneously published on the broadcaster's website. Also, the changes must be communicated to all the television channel distributors with whom they have entered into an interconnection agreement. In this clause, the Amendment has removed the third provision.

 

Principal Tariff Order: Clause 7

Clause 7 of the principal Tariff Order is amended in the following terms:

The Amendment has inserted the following first proviso in the sub-clause (1):

"Provided further that any change in the following beyond first TV connection in a multi-TV home and long-term subscriptions due to the Third Amendment Order of 2022of the Telecommunication Broadcasting and Cable Services 8th Addressable Systems Tariff shall be reported by the Authority:

  • Network Capacity Fee
  • Name
  • Nature
  • Language
  • Distributor Retail Prices of pay channels
  • Distributor Retail Price
  • Composition of Bouquet of Pay Channels
  • Arrangement of a Bouquet of free-to-air channels,
  • Network Capacity Fee for each additional TV connection

 

The changes must be reported to the Authority on its official portal. The changes must be reflected as specified at least thirty days. It must be simultaneously published on the distributor's website. And the Amendment has removed the third proviso.
