In Delhi, the trusts and societies are registered with the Department of Industry of Government of NCT of Delhi, specifically with the Deputy Director/Registrar (Firms and Societies).
Your entity must secure an Essentiality Certificate (EC) from the Department of Education. This certificate confirms that there is a genuine need for a school in the specified area, based on which land can be allocated to the society for the reason of setting up the school. The purpose of the EC is to prevent an oversaturation of schools, which could make existing institutions unsustainable.
The Department of Education assesses the demand for a new school in a particular zone and decides accordingly. By limiting the number of schools in an area, the department also limits how much the market influences school expansion.
Once the EC is granted, the society is required to begin construction within a span of three years. If it fails to do so, a renewal of the certificate must be mandatorily sought.
