Types of Legal Metrology Officers in India and Their Powers

Legal metrology refers to application of legal requirements to measurements and measuring instruments. Its purpose is to ensure accuracy as well as fairness in trade and commercial transactions. In India, the Legal Metrology Act 2009 serves as the primary piece of legislation for regulating weights and measures and preventing unfair trade practices that arise from improper measurements, incorrect weighing or misleading declarations printed on packaged commodities. The Act also provides for appointment of different legal metrology officers at Central and State levels.

Such officers are responsible for enforcing the provisions of the Act. They are also responsible for inspecting weighing and measuring instruments and taking action against violators. In this blog post, we will explain the different types of legal metrology officers in India and the major powers they can exercise under the law.

Below, we have provided you with the list of legal metrology officers and also explained their main powers and responsibilities :-

types of legal metrology officers

1. Director of Legal Metrology

The director of legal metrology is a central government-appointed legal metrology officer. They are the head of the central legal metrology division. Their responsibilities include monitoring national policies pertaining to legal metrology and overseeing technical standards for weights, measures and pre-packaged commodities at a national level rather than at a regional/local level.

The powers of director of legal metrology include conducting technical field inspections, searches, seizures and launching prosecutions against those who violate provisions of the Legal Metrology Act and rules made thereunder.

The director, being the head of central division of legal metrology, manages and supervises all the centre-appointed legal metrology officers. They are empowered to grant importer registration to allow a business to legally import pre-packaged commodities into the country.

2. Controller of Legal Metrology

The Controller of Legal Metrology is a senior state-level officer who heads Legal Metrology Department in a state. Each state generally has its own designated Controller who is responsible for enforcing legal metrology laws within the state.

The Controller's powers and responsibilities include directing enforcement activities, issuing, renewing, suspending or cancelling legal metrology license of manufacturers, repairers and dealers of weights and measuring instruments.

They also monitor businesses’ compliance with legal metrology rules across the state. They may conduct or supervise inspections, searches and seizures against businesses. They may also initiate prosecution against violators.

3. Joint Controller of Legal Metrology

The Joint Controller of Legal Metrology works under supervision and control of State Controller and assists them in managing departmental operations and implementing legal metrology policies.

Their major responsibilities and powers include providing technical/legal guidance and supervising staff and conducting inspections as authorized by the Controller. They oversee and regulate tasks of Deputy Controllers, Assistant Controllers and Inspectors within a specific zone to ensure all of them are fulfilling their duties properly.

They may also handle compounding of offences, support public information officers as per Right to Information Act 2005 and assist with appeals wherever authorised by state government notifications/rules or orders issued by Controller.

4. Deputy Controller of Legal Metrology

The Deputy Controller of Legal Metrology is a state government-appointed legal metrology officer who works under the supervision of senior departmental officers, including the Controller and Joint Controller.

The Deputy Controller usually supervises Legal Metrology Inspectors and Verification officers. If any major issues arise during inspection, they escalate such issues to the Joint Controller. They also exercise delegated powers to compound offences under the law.

Challans that are not compounded are referred to competent court for further proceedings. In many states, consumers can also submit complaints regarding weights and measures to Deputy Controller.

5. Legal Metrology Inspector

Legal Metrology inspectors are state government-appointed enforcement officers. They are key officials that play an essential role in enforcing laws and rules pertaining to weights and measures. They conduct surprise inspections at shops, markets and factories to check for short-weighing, short-measuring and other similar acts of violations.

They also check and verify weighing and measuring instruments like weighing scales, weighbridges and fuel pumps so as to ensure they meet required standards. They are also authorized to seize faulty/unverified instruments and can take legal action against violators.

Final Words…

Different legal metrology officers exercise specific powers given to them under Legal Metrology Act along with certain state specific rules and orders. These officers perform distinct functions to enforce law, maintain integrity of legal metrology and protect consumer interests. While Director of Legal Metrology oversees legal metrology functions at Central Government level, the Controller of Legal Metrology serves as the head of legal metrology department at state level. Together, all of these officers help to ensure compliance with legal metrology requirements and promote fairness in trade/commercial transactions.

The Legal Metrology Act provides legal protection to all the legal metrology officers. The Act states that no suit, prosecution or any other legal proceeding shall lie against such officers for anything they have done or intend to do in good faith while performing their duties under the Act or any rules/orders made under it. This legal protection helps them to carry out their responsibilities properly.
