Which Type of Exporters and Other Entities Can Register Under MPEDA?

The seafood market is growing with an annual CAGR of 9.59% and is expected to grow the same way for 2023-2028. The current value of the processed fish and seafood market is at US $18.58 billion in 2023.

All the seafood businesses in India, need to register themselves with MPEDA. The MPEDA registration is important to check the marine product's raw materials, fixing standards, and specifications. So, the quality will maintain and the business run properly.

Along with this, it is necessary to maintain the quality of the seafood. MPEDA does registration of exporters, fishing vessels, and other processing entities under Section 9(2) (b) and (h) of the MPEDA Act, 1972.

 

MPEDA Certification Required for Exporters and Other Entities

Below are the exporters and other entities who required MPEDA registration to export seafood and set up a specified business.

Manufacturer Exporter

Every applicant can apply online for the registration of exporter in Form IX with a fee of Rs. 5000. After submitting the fees, the application will be automatically submitted to the concerned authority’s head office where the applicant is live

For the submission of the application, signing an authorization letter by one member of the firm is important. Check in the case of different firms who can sign the authorization:

In the case of a sole proprietary firm, the proprietor and his agent can submit the application. Or in the case of an agent, the proprietor should sign an authorization and upload it.

If the applicant is a partnership firm, then the application can sign by one of the partners or agents. Or in the case of a body corporate, any director or attorney of the body corporator can submit the application. The power of attorney must create with the certificate of incorporation.

If all the documents and brand names of the product are submitted properly.  The certificate of registration as an exporter of marine products will grant by the authority. 

Merchant Exporter

Merchant exporters do not own or operate Processing Plants or do not even handle the facility. But take the profit of the processing plant and handling facility. Also, they get their name on the certificate of registration of the processing plant.

The regional and sub-regional offices can not register a new merchant. So, all the applications will forward to Head Office online for further verification. Along with this, the merchant exporters have to submit a bank guarantee of Rs. 15 lakhs for 5 years to MPEDA for honoring the settlement in case of quality complaints and trade disputes.

In case the merchant exporter was first include in the premature termination of an earlier agreement. He will get one more chance to enter into a new agreement.

Route Through Merchant Exporter

It includes an export house, trading house, star trading house, or super trading house which will approve by the Director General o Foreign Trade (DGFT).

The regional and sub-regional offices will issue the certificate of Route Through Merchant Exporter online. But only after filing the application for verification. This certificate will issue by a DGFT which indicates that the firm has the status of Export House/ Trading House/ Star Trading House/ Super Star Trading House.

Ornamental Fish Exporter

The ornamental fish exporter does trade of ornamental fishes and aquatic plants only. Also, they do not engage in the export of live marine products for human consumption.

Processing Plants

The processing plants are the buildings and premises which construct as per the standards of the European Union/ MPEDA or can approve by the Inter-Department Panel. In processing plants, a freezing unit or a processing machine has been installed for processing marine products in any form.

The application for registration will submit to the Secretary with the payment of Rs. 200. The application will make to the registering office having jurisdiction over the location of the plant.  A copy of the project report, plant layout, declaration, and list of machinery with other documents must submit.

Pre- Processing Plant/ Peeling Shed

The pre-processing plant or peeling shed is a building that constructs as per the standards of MPEDA, where the marine products that go through the process of peeling or some processing will be done. The secretary and the other authorized officers have the power to register the plant. 

In case, the applicant’s location is different and the actual location of the plant is different then the Registering Office must have jurisdiction over the location of the plant.

Storage Premises

The storage premises are the place where marine products store in different forms such as frozen, canned, or dried. These marine products use for commercial purposes. 

The application to register the storage premises must file in Form II on payment with a fee of Rs. 200 and submit to the Regional/ Sub-regional Officers, Trade Promotion Office with jurisdiction over the location premises. 

Fishing Vessels

A fishing vessel is a ship or a boat which is fully equipped with the mechanical means to engage in the sea-fishing business. As per the Department of Commerce, and Ministry of Commerce, there are two types of vessels:

Freezer Vessels: These vessels use where fishery products are frozen and stored for further processing and packaging. 

Fishing Vessels: These vessels engage in fishing activities where fishery products store for processing, freezing, and packing.

Fresh/ Chilled Fish Handling Centre

Every applicant needs to submit an application for registration to the Secretary or other officer authorized in Form II (b) with a fee of Rs. 200. An applicant who wants to do business in the processing and export of marine products to countries other than Europe Union must do this registration. Submit a copy of the norms prescribed for the fresh/ chilled fish handling center with the application. 

Premises for Handling Live Fish

For live fish handling center, the application must submit to the secretary or other officer authorized in Form II (c) with a payment of Rs. 200. It will include the handling of the center or fattening any trade varieties of fish such as mollusks, crustaceans mean for human consumption.
